This Charter applies to the Simsoft Industry Website
Under this Charter, unless the context imposes a different definition, the following words and phrases, whether singular or plural, will have the following meaning:
“SIMSOFT INDUSTRY”refers to Simsoft3D SAS with a capital of 14,000 euros, registered in the Register of Commerce and Companies of Toulouse under the number B 791 852 288, whose head office is at 815, La Pyrénéenne 31670 Labège, France.
“Charter”refers to this charter on the protection of personal data and commitments of confidentiality and security;
“CNIL”refers to the National Commission for Information Technology and Freedoms;
“Personal data” Personnellesrefers to the User’s personal information;
“SIMSOFT INDUSTRY”refers to the group of companies within the meaning of Article 4.19 of the RGPD which exercises control of SIMSOFT INDUSTRY and the companies it controls;
“RGPD”refers to the General Data Protection Regulations 2016/679 of 27 April 2016;
“Site”refers to the site accessible to www.simsoft-industry.com address;
“Treatments”collectively refer to the management, collection, protection and retention of the User’s Personal Data;
“User”refers to the site user, whether he is a customer or a simple visitor to the Site.
SIMSOFT INDUSTRY has implemented this Charter so that users can share their Personal Data in accordance with a strict privacy and security policy by which SIMSOFT INDUSTRY is committed to protecting their privacy and managing their Personal Data in a fair and transparent manner.
In order to ensure the proper implementation of its commitments as responsible for the processing of personal data collected on the Site in accordance with the RGPD and the Computer and Freedoms Act in its latest version, SIMSOFT INDUSTRY has appointed a data protection representative in charge of information protection and personal data protection advice who can be contacted by email to: email@example.com
SIMSOFT INDUSTRY informs the User that it can collect or obtain personal data provided by the User when ordering on the Site (for example, through a form on the Site) or if their Personal Data is available to the public.

As such, the Site is not designed for or intended for use by children under the age of 16. SIMSOFT INDUSTRY’s policy is never to knowingly collect or store information about anyone under the age of 16.
Depending on one or more treatment purposes, SIMSOFT INDUSTRY will be required to disclose all or part of the Personal Data.

The User is informed that his Personal Data may be transferred to a country other than his country of residence, within the European Union.

When the User has checked the box indicating:

If the User no longer wishes to receive information and offers from SIMSOFT INDUSTRY via Email and/or SMS, their opt-out request may be sent to email@example.com.
SIMSOFT INDUSTRY takes all necessary precautions, including organizational, technical, software and physical digital security measures to protect the User’s Personal Data from fraudulent loss, theft and subtraction, as well as from unauthorized access, disclosure, tampering or destruction of Personal Data.
However, it should be noted that the Internet is not a completely protected environment and the Site cannot guarantee the security of the transmission and storage of information on the Internet.
SIMSOFT INDUSTRY implements all measures useful in light of the nature of the data collected and the risks presented by the Processing, to preserve the security of Personal Data and, in particular, to prevent it from being distorted, damaged, or accessed by unauthorized third parties.
In accordance with national and European law, the User is entitled to exercise the following rights with SIMSOFT INDUSTRY, which processes its Personal Data:
▪ to be informed of the existence and purposes of any Processing of his Personal Data
▪ to access his Personal Data and ask for their correction or removal or a limitation of treatment;
▪ to object to the processing of its Personal Data and to ask for its portability;
▪ to withdraw, at any time, its consent given to SIMSOFT INDUSTRY;
▪ to promptly inform the data protection representative of any fraudulent loss or subtraction (illegal processing) of his Personal Data.
For the exercise of these personal rights, the User may e-mail firstname.lastname@example.org, in accordance with this Privacy Charter.
The User is informed of the existence of the list of opposition to the telephone canvassing “Bloctel”, on which he can register here: https://conso.bloctel.fr/
In the event of dissatisfaction with the way WEBCOM AGENCY handled Personal Data or any questions or requests raised with the email@example.com that would have been unsuccessful, the User is entitled to file a complaint with the CNIL.
The User also has the option to contact the firstname.lastname@example.org in order to be redirected to the CNIL or for any questions or concerns regarding privacy issues or the management of personal data concerning him.
The User’s Personal Data will be held by SIMSOFT INDUSTRY for the longest period of time: (i) the time required to complete the following operations: (a) sending information and offers via Email and/or SMS, (b) order registration, (c) order delivery and delivery (d) withdrawal of orders; (ii) any period of retention imposed by law; Yes (iii) at the end of the statute of limitations following a dispute or investigation that may arise in the context of the relevant transactions, unless prior request for removal sent to email@example.com.
